Terms & Conditions

Definitions
“Customer” is you - the person/s buying the products as specified on the invoice, document or order.
“Hibernate” means the brand that is owned by Secret Gardens of Sydney Pty Ltd ABN 12085277078
“Products” means all products, goods or services supplied by Hibernate to the Customer at the Customer’s request.

Prices
All prices are in Australian dollars.

Payment
Full payment of goods is due prior to delivery. We accept the following forms of payment:

EFT, Credit Card, PayPal, Apple Pay

If you would like us to hold Hibernate products, we are happy to put your products into hibernation with a 50% deposit. When you are ready for the products to be sent to you, pay the final 50% balance and the hibernation is over. Please contact us on hello@hibernateoutdoors.com.au to arrange this. If products are unavailable at the time of an order you may place the item on back order to secure products when they come back in stock.

Delivery
Delivery costs are detailed separately on each invoice and are in addition to the prices specified on the Hibernate site. Once delivery is scheduled the Customer must be available to take delivery by receipt or collection of the Products when they are scheduled for delivery. In the event that the Customer is not available to take Delivery of the Products as arranged then Hibernate shall be entitled to charge 20% restocking fee, and return delivery fees will be charged to the Customer.
As we use Third Parties for Delivery, this is to the kerb only, and does not offer unwrapping and placement of the Products or the movement of goods through the property. If the Customer uses their own transportation for Delivery of the Products, Hibernate is not liable for any claims against defects/damages to the Products as a result of Delivery.

Delivery is by courier and will be delivered to your door at street level. If you require assistance to carry pots inside or upstairs we will need to organise a removalist and a quote provided.

Delivery (“Delivery”) of the Products is taken to occur at the time that:

The Customer or the Customer’s nominated carrier delivers the Products at the Customer’s address; or

The Company (or Hibernate’s nominated carrier) delivers the Goods to the Customer’s nominated address even if the Customer is not present at the address.

Defects and Returns
We inspect all products prior to packing and shipping but are conscious that we want our Hibernate products to be delivered to you in the same condition. Please inspect the Products when you receive them. You need to notify Hibernate within 24 hours of acceptance of Products, in writing of any evident defect/damage, shortage, or failure to comply with the description or quote.
We cannot accept any fault post 24 hours.  Hibernate does not offer an ongoing warranty once the products are installed. This is due to the nature of the Products and the exposure to the elements, water, soil etc. If you change your mind, unfortunately Hibernate cannot accept returns, exchanges or provide a refund. Full refunds including shipping costs will be available in the instance of a major fault/defect as per Australian Consumer Law.
Should a valid warranty claim be made, Hibernate is not liable for any costs associated or incurred by the customer as a result of removing & re-installation of faulty pots.

If you have requested drainage holes, we are unable to accept returns.

Any modifications or changes made to the Products will automatically void all warranty.

Natural Variations in Hibernate Pots
Hibernate pots are handcrafted so there will be some variations – this is what we love about them. Over time you acknowledge that they may expand, or distort as a result of exposure to heat, cold, weather or mark or stain when exposed to certain substances.

Acceptance
By placing an order for or accepting delivery of goods, the Customer is taken to have exclusively accepted, and is bound by, these terms and conditions. These terms and conditions may only be amended with Hibernate’s consent in writing.

Installing Facts and Guidelines
Hibernate pots may have drainage holes pre drilled or may need them to be drilled for water movement. Please check that these holes are not blocked before planting/installing soil. We recommend placing drainage cell, shade cloth and blue metal. We can offer this as a separate kit (the drainage cell and shade cloth) if required and can be added to your order.  The drainage cell and shade cloth should cover the entire floor of the pot, particularly the drainage holes. The blue metal, about 100mm layer should be installed on top of this. This can be purchased from your local hardware store.

Add your good quality potting mix suitable for the plant choice you are using. You can get a recommendation from your nursery or where you purchase your plants.

Once planted the pots (Products) should be elevated above ground, this includes on decks, turf etc to ensure water isn’t blocked from exiting the drainage holes. We recommend using pot feet, we use plastic window packers available from most hardware stores and you can also purchase this through the Hibernate site.

Excess water in the soil due to not following the above specifications can affect the structural integrity and the exterior finish of the pot (Products).

Privacy
Hibernate respects your privacy and this is an important part of our relationship with our customers. The following privacy policy applies to all Hibernate users, and conforms to Internet privacy standards.

Collection of Information
We may require information from you in order to provide the best service possible whilst using the Hibernate site. This may include all correspondence particularly in regard to sales, support and accounts. This may be via the telephone, email, mail, or directly through our site.

Any details collected from customers is required in order to provide you with our products and/or services, and a high level of customer service.

Storage of Collected Information
The security of your personal information is important to us. When you enter sensitive information (such as credit card numbers) on our website, the platform encrypts that information using secure socket layer technology (SSL). When Credit Card details are collected, we simply pass them on in order to be processed as required. We never permanently store complete Credit Card details.

Access to Collected Information
At any time you may request us to update, delete or deactivate your details and information by emailing hello@hibernateoutdoors.com.au

Communications
Hibernate uses personally identifiable information for essential communications, such as emails, accounts information, and delivery details. We may also use this information for other purposes, including promotional emails or special offers that may interest you. If at any time a customer wishes not to receive such correspondence, just request to be removed from any mailing lists by emailing us at hello@hibernateoutdoors.com.au.

Third Parties
Hibernate may at its discretion use other third parties to provide essential services on our site or for our business processes. We may share your details as necessary for the third party to provide that service e.g. such as delivering your Hibernate products.

These third parties are prohibited from using your personally identifiable information for any other purpose.

Legal
We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Website.

Changes to Privacy Policy
If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.

Cookies
Our Site may use “cookies” to enhance User experience. User’s web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. User may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If they do so, note that some parts of the Site may not function properly.
